A BILL to amend and reenact section two, article two,
chapter sixty-four of the code of West Virginia,
one thousand nine hundred thirty-one, as amended,
relating to authorizing the division of personnel
to promulgate a legislative rule relating to
workers' compensation temporary total disability.
Be it enacted by the Legislature of West Virginia:
That section two, article two, chapter sixty-four of
the code of West Virginia, one thousand nine hundred
thirty-one, as amended, be amended and reenacted, to read
as follows:
ARTICLE 2. AUTHORIZATION FOR DEPARTMENT OF
ADMINISTRATION TO PROMULGATE LEGISLATIVE RULES.
§64-2-2. Division of personnel.
(a) The legislative rule filed in the state register
on the first day of August, one thousand nine hundred
ninety-seven, under the authority of section ten, article
six, chapter twenty-nine, of this code, modified by the
division of personnel to meet the objections of the
legislative rule-making review committee and refiled in the state register on the seventh day of January, one
thousand nine hundred ninety-eight, relating to the
division of personnel (administrative rule of the West
Virginia division of personnel, 143 CSR 1), is
authorized, with the following amendment:
"On page 35, Subsection 12.6, by following the words
'wage or salary' by inserting the following: 'or is paid
temporary total disability under the provisions of
section one, article four, chapter twenty-three of this
code,'."
(b) The legislative rule filed in the state register
on the sixth day of August, one thousand nine hundred
ninety-nine, under the authority of section four, article
five-a, chapter twenty-three, of this code, modified by
the division of personnel to meet the objections of the
legislative rule-making review committee and refiled in
the state register on the twenty-seventh day of October,
one thousand nine hundred ninety-nine, relating to the
division of personnel (workers' compensation temporary
total disability
, 143 CSR 3), is authorized.
NOTE: The purpose of this bill is to authorize the
Division of Personnel
to promulgate a legislative rule
relating to Workers' Compensation Temporary Total
Disability
.
